ARTICLE 1 - DEFINITIONS

Under these conditions, we mean by :

1. Cooling-off period: Period during which the customer can make use of his right of withdrawal;
2. Customer : Natural person who does not act for purposes relating to a commercial, craft or professional activity and who has placed an order on the Rmed.be site;
3. Day : Working day;
4. Right of withdrawal: The possibility given to the customer to return one or more products during the cooling-off period;
5. Company: Natural or legal person who offers products on the Rmed.be site;
6. Order: Request for goods accompanied by payment on the Rmed.be site;

ARTICLE 3 - SCOPE OF APPLICATION

1. These general terms and conditions apply to every order placed on the RMed.be website.
2. The text of these general terms and conditions is placed on the site for information purposes.
3. The text of these general terms and conditions is also made available to the customer at his request by electronic means or in the order confirmation e-mail sent by our customer service department.
4. The text of these general terms and conditions is attached to the customer's invoice.

 

ARTICLE 4 - OFFERS

1. If an offer is subject to special terms and conditions, it shall state this explicitly.
2. Concerning the sale of devices treating sleep apnea (CPAP and auto CPAP), a medical prescription indicating the clinical parameters is mandatory. It must be sent to our customer service within 15 days following the date of order by :

3. The offer includes an accurate and complete description of the products. The description shall be sufficiently detailed to allow a proper evaluation of the offer by the customer. If the company uses illustrations, they shall be a true representation of the products. Obvious errors or mistakes in the offer are not binding on the company. However, the company cannot guarantee the perfect similarity of the colours of the reproduction with the real colours of the goods offered.
4. All images, specifications and data included in the offer are for information purposes only and may not give rise to any compensation.
5. Each offer contains such information that the client is aware of the rights and duties inherent in the acceptance of the offer.

 

ARTICLE 5 - ORDERS

1. Subject to the provisions of Article 4, when the customer places an order, he accepts the offer and the special conditions to which it is subject.
2. The company will confirm the order electronically within 15 working days of the order date at the latest. Except in the case mentioned in Article 4(2), the company will confirm the order after receiving the medical prescription from the customer at the latest within 15 working days from the date of receipt.
3. As long as the order has not been confirmed by the company, the customer may cancel the order. The company reserves the right to cancel the order automatically if the customer has not sent the medical prescription within 15 days of the order date and will refund the amount within 15 working days of the cancellation date.
4. The company has taken technical measures to guarantee the protection of personal data and secure payment on the site.

6. After confirmation of the order by the company, the company will proceed with the delivery.

 

ARTICLE 6 - RIGHT OF WITHDRAWAL

1. The customer has a reflexion time period of 15 days. The company may ask the customer to give the reason for his withdrawal.
2. The cooling-off period referred to in paragraph 1 shall begin on the day following the date of receipt of the order by the customer.

 

ARTICLE 7 - OBLIGATIONS OF THE CUSTOMER IN CASE OF WITHDRAWAL

1. During the reflexion time period, the customer shall treat the product and packaging with care. He will only look at the product to assess the characteristics of the product and its functioning. The principle being that the customer shall only handle and inspect the product as he would do in a shop.
2. Returned products will be systematically checked by the technical workshop and the customer is only responsible for the loss of value of the product due to a way of handling the product other than permitted under paragraph 1.
3. If the customer makes use of his right of withdrawal, he shall notify this before the end of the cooling-off period by e-mail to the following address: [email protected].
4. Within 15 days from the date of transmission of the electronic cancellation under paragraph 3, the customer shall return the product or hand-deliver it, together with the cancellation form, to the following address: Rmed - chemin du Grand Marais, 50 -7822 Isières, Belgium.
5. The customer must return the product before the end of the cooling-off period with all accessories supplied, in the original condition and packaging, accompanied by the withdrawal form.
6. The return costs are at the customer's expense. In the event of disputes concerning the cooling-off period, the customer will have to provide proof that the cooling-off period has been respected (e.g. dispatch note...).

 

ARTICLE 8 - OBLIGATIONS OF THE COMPANY IN CASE OF RETRACTION

1. The company will send a confirmation of withdrawal electronically at the latest within 15 working days from the date of receipt of the request.
2. The company will reimburse all payments made by the customer, including any delivery costs charged by the company for the returned product, at the latest within 15 working days after the day of receipt and the end of the shop check of the product.

3. If the order is returned to RMed without the customer having taken the trouble to receive it, at home, at a relay point or at a post point, RMed reserves the right to deduct the shipping costs from the total amount of the refund to the customer. This is to avoid abuse and the costs incurred by such behaviour (administrative costs, packaging, preparation, commission to the payment service provider, postage and return costs).

 

ARTICLE 9 - EXCLUSION OF THE RIGHT OF RETRACTION

The company excludes from the right of withdrawal, products that are sealed, or whose packaging is sealed, which cannot be returned for health or hygiene reasons and whose seal, or sealed packaging, has been broken after delivery (masks, mandibular advancement orthoses, hoses, filters, humidifiers, devices, any single-use products ...). The same is true for any product exposed to stains or suspicious odours (grease, cigarette smoke...) as well as for any device used.

 

ARTICLE 10 - PRICES

1. The prices of the products displayed on the site are in euros and include all taxes.
2. The prices indicated do not include transport costs.
3. The Recupel recycling fee is included in the prices of electrical and electronic products.
4. The company reserves the right to modify the prices at any time; however, the prices displayed at the time of the order are those in force after the confirmation of the order by the company.
5. The company also reserves the right to pass on in the prices, the modifications of the rate of the VAT which would intervene before the delivery date.

 

ARTICLE 11 - DELIVERIES

1. Deliveries will be made to the address indicated by the customer at the time of the order on our site.
2. Taking into account article 4 of these general terms and conditions, the company will execute the orders confirmed by the latter at the latest within 30 days following the date of order. If the delivery is delayed or if an order cannot be executed, the customer will be informed electronically within 30 days of the order date at the latest. In this case, the customer has the right to cancel the order by informing the company electronically at the following address: [email protected]. The company will refund the amount paid by the customer within 15 working days from the date of the cancellation request.
3. In the cases mentioned in article 4 paragraph 2 and at the latest within 15 days following the date of the order, the customer will have to provide a medical prescription for the products concerned. In such cases, the company reserves the right to automatically cancel the order and delivery. It will proceed to refund the amount paid by the customer within 15 working days following the date the cancellation is sent electronically.

4. RMed cannot, under any circumstances, be held responsible for any delays in delivery attributable to the company in charge of the said delivery.

The same applies if the delivery address provided by the customer is incorrect or incomplete or if the customer does not pick up his order within the time specified. The shipping costs will remain in these cases at the full charge of the customer and not reimbursed in the event of return of the order to RMed.

 

ARTICLE 12 - TERMS OF PAYMENT

1. In the case of an order placed on our site, the amounts owed by the customer must be paid in advance.
2. The accepted means of payment are :

- VISA/MasterCard
- Maestro
- Credit Card
- Paypal

 

ARTICLE 13 - PROCESSING OF COMPLAINTS

1. Complaints about the execution of an order must be sent to the company within 30 days of the order date at the latest, together with a full and clear description, by e-mail to the following address: [email protected].
2. Complaints submitted to the company will be replied to within 15 working days after the date of receipt. If a complaint requires a longer processing time, the company will reply within 15 working days with a confirmation of receipt and an indication of the date by which the customer can expect a more detailed reply.
3. If the complaint cannot be resolved by mutual agreement within a reasonable period of time or at the latest within three months after the complaint has been sent, it becomes a dispute and will be treated as such.

 

ARTICLE 14 - DISPUTES

1. Orders placed on the Rmed.be site are governed by these general terms and conditions and are only subject to Belgian law.
2. Disputes between the customer and the company concerning the execution of orders for products supplied by the company can be brought before a judge by the customer or the company.

 

ARTICLE 15 - GUARANTEE

1. All products sold on the Rmed.be site benefit from the manufacturer's guarantee.
2. The company guarantees the products sold, in fact the customer who notices the non-conformity of a product sold must inform us within 2 months following the delivery date at the following address: [email protected].
3. This guarantee only covers defects in conformity existing at the time of delivery of the goods. Defects or damage due to misuse, such as dropping or impact, negligence and wear and tear, oxidation, breakage and water damage, are not covered by the warranty. Similarly, repairs carried out by technicians outside our workshops will void the warranty. The invoice or delivery note serves as a guarantee title and must be kept by the customer and provided in original in case of non-conformity.

 

ARTICLE 16 - PERSONAL DATA

1. All personal data required to process an order is kept by the company. They may be passed on to companies with which we collaborate in the event that the transmission is necessary for the processing of an order.
2. The customer also agrees to the use of this data for statistical purposes in order to improve our website and the goods on offer.
3. The company undertakes not to disclose the personal data of customers to any other company or business.
4. At any time, customers can request the modification or deletion of this personal information at the following address: [email protected]. However, the data kept will enable the company to facilitate subsequent orders.
5. This data may be used to disseminate, by any means of communication, information relating to the activity of the rmed.be site to our customers.

 

ARTICLE 17 : REMOTE ASSIST – AIRVIEW

By accepting the general terms and conditions of sales of Remote Assist - AirView, the customer implicitly authorizes RMed to access his/her CPAP/Auto-CPAP device in order to monitor his/her treatment. The customer may, at any time and at no cost, cancel the monitoring of his/her treatment by Remote Assist - Air View by sending a simple e-mail to [email protected].
